Acoustical Fulfillment Dealer Portal Terms of Use
By accessing the Acoustical Fulfillment Dealer Portal (the “Portal”), you agree to be bound by the following Terms of Use. These terms constitute a legal agreement between you (the “User,” representing an Authorized Dealer or Manufacturer’s Representative) and Acoustical Fulfillment LLC (“AF”).
- AUTHORIZED USE ONLY
Access to this Portal is strictly limited to authorized Dealers and Manufacturer’s Representatives currently in good standing with Acoustical Fulfillment. By logging in, you represent that you are an authorized agent of your company and have the authority to view project details, pricing, and account information. - CONFIDENTIALITY & NON-DISCLOSURE
The information contained within this Portal is highly confidential and proprietary to Acoustical Fulfillment. This includes, but is not limited to:- Wholesale dealer pricing and margins
- Manufacturer’s representative commission structures
- Proprietary acoustical analysis, RT (reverberation time) reports, and room diagrams
- Client and project leads
You agree not to share, distribute, or disclose your login credentials or any internal data found within this Portal to any third party, including end-users, without the express written consent of AF. Pricing displayed here is for the Dealer/Rep only; only the final “End User Quote” or “MAP” (Minimum Advertised Price) should be shared with the customer.
- PRICING AND QUOTES
While AF strives to ensure all data in the Portal is accurate, technical errors may occur.- Source of Truth: The official PDF Quote generated by AF Sales Engineering and sent via email/PandaDoc supersedes any pricing displayed dynamically in the Portal dashboard.
- Price Changes: As per our standard policy, all prices are subject to change without notice. Possession of access to this Portal does not constitute a locked price or the right to sell products without a formal Purchase Order acknowledgment.
- INTELLECTUAL PROPERTY
All intellectual property provided through this Portal, including product designs (e.g., Flex-48™, FulFill™ Acoustical Panels), acoustic modeling, and brand assets, remain the sole property of Acoustical Fulfillment. You are granted a limited, revocable license to use these materials solely for the purpose of selling AF solutions to your clients. - ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your username and password. You agree to notify Acoustical Fulfillment immediately (via team@acousticalfulfillment.com) if you suspect unauthorized access to your account or if an employee with access leaves your organization. - DATA SUBMISSION
By submitting project data (room dimensions, photos, client details) into the Portal, you grant AF the right to use this data to generate acoustical analyses and quotes. You represent that you have the right to share this client information with us for the purpose of fulfilling the project. - TERMINATION OF ACCESS
Acoustical Fulfillment reserves the right to suspend or terminate Portal access at any time, for any reason, including but not limited to breach of these Terms, inactivity, or termination of the Dealer/Rep agreement. - LIMITATION OF LIABILITY
The Portal is provided “as is.” Acoustical Fulfillment shall not be liable for any direct, indirect, or consequential damages arising from the use of, or inability to use, this Portal or for any errors in the data provided herein. - GOVERNING LAW
These terms shall be governed by the laws of the State of New Jersey. Any disputes arising from these terms shall be resolved in the courts of Ocean County, New Jersey.
